1. Introduction

The Promotion of Access to Information Act, 2000 ("PAIA") gives effect to the constitutional right of access to information held by public and private bodies where such information is required for the exercise or protection of any rights.

This Manual has been prepared in accordance with Section 51 of PAIA and describes the records held by BLAQTACH (Pty) Ltd, the procedure for requesting access to those records, and the manner in which such requests are dealt with.

Nothing contained in this Manual limits any rights or obligations arising under the Protection of Personal Information Act, 2013 ("POPIA") or any other applicable legislation.

The purpose of this Manual is to:

9. Request Procedure

A requester seeking access to records must:

  1. Submit a written request to the Information Officer.

  2. Clearly identify the requested record.

  3. Explain the right to be exercised or protected.

  4. Explain why access to the record is required.

  5. Provide sufficient contact details.

  6. Provide proof of identity where required.

BLAQTACH may request additional information where necessary to verify the identity or authority of the requester.


10. Fees

Where permitted under PAIA, prescribed request fees, access fees and reproduction fees may be charged.

The applicable fees shall be those prescribed by law from time to time.

Where no fee is prescribed, no fee shall be charged.


11. Grounds for Refusal

Access to records may be refused where required or permitted by PAIA, including but not limited to:

  • Protection of personal information.

  • Commercial confidentiality.

  • Legal privilege.

  • Confidential third-party information.

  • Ongoing investigations.

  • Protection of safety.

  • Records prohibited from disclosure by law.

Each request shall be considered individually.


12. Processing of Personal Information

BLAQTACH processes personal information in accordance with POPIA.

Processing activities may include:

  • Collection

  • Recording

  • Storage

  • Updating

  • Verification

  • Transmission

  • Archiving

  • Secure destruction

Processing occurs only for lawful purposes and only to the extent reasonably necessary to provide services or comply with legal obligations.
